3 x Two Storey Grouped Dwellings

The City has received an application for a three two-storey grouped dwellings at the abovementioned address. The application proposes variations to the City’s Fill and Fencing Policy and the deemed-to-comply provisions of the R-Codes which are as follows:

  1. Street setbacks – Unit 2 is proposed to be setback a minimum of 0.75m to the common property driveway boundary in lieu of 2.5m.
  2. Lot boundary setbacks – the following setbacks variations are proposed:
    1. Unit 1 has the ground floor setback 1.2m in lieu of 1.5m to the western side lot boundary;
    2. Unit 3 has the ground floor setback 1.2m in lieu of 1.8m to the southern rear lot boundary; and
    3. Unit 3 proposes building up to three lot boundaries in lieu of only one lot boundary.
  3. Open space – Unit 2 is proposed to have 40.33% open space in lieu of the minimum 45% required.
  4. Outdoor living areas – the following outdoor living area variations are proposed:
    1. Unit 1 is proposed to have the outdoor living area within the front setback area;
    2. Unit 2 is proposed to have 11.174sqm uncovered outdoor living area in lieu of the minimum 13.33sqm required;
    3. Unit 3 is proposed to have 10.345sqm of uncovered outdoor living area in lieu of the minimum 13.33sqm required;
    4. Unit 3 is proposed to have an outdoor living area with a minimum dimension of 3.5m in lieu of 4m.
  5. Street Setback fencing – the fencing perpendicular to the street within the 9m front setback area is proposed to have one pier at 2.2m in lieu of the maximum 2.1m permitted and in-fill height at 1.95m in lieu of the maximum of 1.8m permitted above natural ground level.
  6. Visual privacy - the following visual privacy setbacks are proposed: 
      1. The unit 1 upper floor sitting room is proposed to have a 4.75m setback in lieu of 6m to the eastern side lot boundary; and
      2. The unit 3 sitting room have a setback of 5.5m in lieu of 6m to the eastern side lot boundary.
  7. Outbuildings – Unit 3 has the store separate to the dwelling with a nil setback to the southern and eastern side lot boundaries in lieu of being setback 1m
