Deemed to Comply Check

In February 2021, new provisions were introduced in the Planning and Development (Local Planning Schemes) Regulations 2015 (the Regulations) which aim to streamline and improve the process for owners applying for alterations and additions to single houses and the construction of new single houses.

The new clause 61A process allows owners to seek advice from their local government as to whether or not the proposal is exempt from requiring development approval, referred to as a ‘Deemed-to-Comply’ check.

Following lodgement and assessment of a Deemed-to-Comply Check, applicants are provided with written confirmation within 14 days as to whether their development proposal satisfies the exemption criteria and can progress to a Building permit, or if the development proposal requires discretion to be exercised through Development Application. 

Deemed-to-Comply checks can be submitted electronically via the Planning Department's enquiry form, in person to the City's Administration Office or alternatively by post to PO Box 9, Nedlands WA 6009.
