How to apply for a building permit

  1. Please read the information below and select the permit relevant to your building type. If you are unsure, please submit a building permit enquiry.
  2. Once you have selected your permit type, please complete the relevant forms and checklists provided in the information below.
  3. Save your completed forms to your device (PC, laptop etc).
  4. Submit your completed forms by attaching them to this enquiry form.
  5. A buildings officer will then contact you if they require further information, or if your permit has been approved.

The City also accepts applications submitted on USB storage media. 

Building Applications

Building permit application for new buildings and structures

Applying for a building permit (for a new building or structure) can be done via a certified (BA01) or uncertified (BA02) application.

A certified application applies to all building classes. The application form must be supplied with a signed Certificate of Design Compliance (BA03) provided by a private Building Surveyor – with all referenced documentation on the certificate supplied, at time of lodgment to the City. 

 

Certified applications are processed and issued within the statutory 10 working day timeframe (Building Regulations 2012).

All certified building applications must be lodged with the below checklist completed.

An uncertified application is only applicable for Class 1 and 10 buildings/structures. A registered Building Surveyor at the City will sign a Certificate of Design Compliance (BA03 Form). For the Building Surveyor to determine compliance with the NCC BCA and applicable Australian Standards, relevant documentation is required. To avoid processing delays, all documentation must be supplied when lodging the application. 

 

Uncertified applications are processed and issued within the statutory 25 working day timeframe (Building Regulations 2012).

Construction Management Plan


A Construction Management Plan (‘CMP’) is necessary to ensure construction, demolition and excavation on building sites do not adversely affect health, safety,
amenity, traffic or the environment in the surrounding area.

Building permit application for an amendment to building works (under a previously approved building permit)

Where amendment(s) are proposed to building works under a previously approved building permit, a BA19 application is required to be submitted accompanied by a new Certificate of Design Compliance (BA03) and the documentation referenced on the Certificate. 

 

The Certificate of Design Compliance for a BA19 application must reference the previously approved building application number and the specific amendment to the building work. 

 

The documentation must be relevant to the amendment(s) proposed – with the changes marked or highlighted for clarity.

Building permit applications to change nominated building (under a previously approved building permit)

A change to the nominated builder (on a previously approved building permit) must be applied for via a completed BA19 application form.

Retrospective building permit applications

Retrospective building permit application for residential buildings and structures (Class 1 and 10 buildings)

Where building and structures that require a building permit have been constructed without approval, a BA13 application is required. The application is to be accompanied by a Certificate of Building Compliance (BA18) signed by a private certifier – with all documentation referenced on the Certificate provided at the time of lodgement at the City.

Unauthorised Building Approval Checklist

Retrospective building permit application for commercial buildings and structures (Class 2-9 buildings)

Where buildings and structures that require approval have been constructed without authorisation, retrospective approval may be applied for.

The application is to include an Application for Occupancy Permit (BA09), accompanied with a Certificated of Building Compliance (BA18) signed by a registered building surveying contractor - with all documentation referenced on the Certificate provided at time of lodgement.

Other building permit applications and forms

Application for an occupancy permit (prior to occupation of a commercial building)

To allow completed Class 2-9 buildings to be occupied, an application for an occupancy permit is required. This application also applies where a change of classification or use is proposed to an existing building.  

A BA09 application form, accompanied by a Certificate of Construction Compliance (BA17) or Certification of Building Compliance (BA18) must be supplied to the City together with all documentation referenced on the Certificate.

Application to extend time (to an occupancy or building approval certificate)

Where an extension to an occupancy or building approval certificate is required, a BA22 application must be applied for. Please contact Building Services at the City, for further information. 

BA23 – Application to extend time – occupancy permit or building approval certificate

Application to extend time (to a building or demolition permit)

Where an extension to a building or demolition permit is required, a BA22 application must be applied for. Please contact Building Services at the City, for further information.

Demolition Permit Applications

Where a demolition permit is required, a BA05 application must be completed and submitted to the City. Each application is to be accompanied with a site plan indicating the extent of the demolition.   

A rat baiting certificate from a licensed pest controller and intent to disconnect notices (water/sewer, gas and electricity) may also be required – depending on the building/structure to be demolished. 

BA05 – Application for demolition permit

Demolition permits are required where demolition or removal of a building or incidental structure is proposed. Some exceptions apply when the demolition is a shed, patio or carport (Class 10a) which is less than 40m2 in size. If the structure contains any asbestos or asbestos containing material, a permit will be required. 

Demolition of all other types of structures will require a demolition permit. 

Partial demolition work also generally requires a permit.  To clarify your situation please contact the Building Services.

Demolition Approval Checklist

All demolition applications must include a rodent treatment plan or certificate of baiting that nominates the use of First Generation Rodenticides only. Second generation rodenticides are no longer permitted for use within the City of Nedlands

Application fees can be calculated using the Fee Calculator 2 available from the Fee calculators and forms section of the Building Services website. 

Bonds for demolition works apply to all applications and are shown on the fee calculator.   Bonds are required to be paid at the time of lodging a demolition permit application. 

When a completed application is submitted, a Demolition Permit will be issued within 10 working days. 

If part of the verge is to be used during demolition, a Permit to Use the Verge and/or Thoroughfare is required. Please refer to the permit to use the verge and/or Thoroughfare application details found in the following drop down section

Permit to use the Verge and/or Thoroughfare application

To use the verge or thoroughfare for storage of materials or the creation of a working zone during construction works associated with a building permit, a verge use permit is required. 

This permit allows the City’s verges and thoroughfares to be used as a building site including the placement of materials, sheds, toilets and any other items required to complete the building.  It also includes the mixing of cement and the placing of cranes and other machinery. 

The permit requires the area used, to be fenced and screened, both for security and to prevent any materials leaving the site and entering City infrastructure. The area surrounding this permit (footpaths, roads) is to be kept clean, with further conditions dependent upon specific use by the applicant. 

Potential consequences of failing to have an approved Verge and Thoroughfares Permit, or contravention of its conditions, can include: 

  • Stopping all works being conducted
  • Removal of all items stored or parked on the thoroughfare (including cranes, trucks, concrete pumps and materials)
  • On the spot fines
  • Cancellation of the permit
  • Court prosecution

Notice of Completion

At the completion of works, a Notice of Completion (BA07) must be filled out, signed and returned to the City of Nedlands. These forms are provided with the building approval forms that the City will issue as a part of your building permit, however if required you can access them by clicking here. Please ensure the description of works and building permit number align with the previously supplied building permit to avoid further delays.
